Tuesday, Zimmerman to ask if he can leave Seminole County and take off his GPS monitor.

During a court hearing Tuesday, George Zimmerman may find out whether he can leave Seminole County and take off his GPS monitor.

On Friday, his lawyers filed motions asking a judge to let him leave the county. They said he needs to meet with legal experts and witnesses.

His attorneys said it’s for his own safety because Zimmerman has been threatened in the past.

“Mr. Zimmerman is still at great risk of serious bodily harm, at great risk in his community, and has had to continue to live in seclusion and hiding. An increase in antagonism and threats towards him which is cause for additional concern for his safety and security,” wrote Mark O’Mara, Zimmerman’s defense attorney.

A hearing has been scheduled for Tuesday at 9 a.m.

George Zimmerman asked a judge this week to stop a subpoena for his medical records. A hearing is set for Friday.

ORLANDO, Fla.  — The former neighborhood watch leader charged with fatally shooting Trayvon Martin is objecting to prosecutors’ request for his medical records.

George Zimmerman asked a judge this week to stop a subpoena for his medical records. A hearing is set for Friday.

Zimmerman says the request is too broad and will include information that is irrelevant.

The medical information would be made public if it is released to prosecutors under Florida’s discovery rules.

Zimmerman is asking that the judge review the medical records and decide which, if any, should be released.

FDLE checked samples from the gun’s grip and found no evidence that Trayvon had handled it. (Zimmerman Caught Lying Again)

Prosecutors today released another batch of evidence in the second-degree murder case against George Zimmerman, including more than 200 photos, but a quick review suggests there were no bombshells.

Among the new evidence is a series of DNA reports from the Florida Department of Law Enforcement. They reveal that DNA tests on Zimmerman’s gun and holster found evidence of multiple handlers, but none that matched Trayvon Martin, the unarmed 17-year-old Zimmerman fatally shot in Sanford Feb. 26.

FDLE checked samples from the gun’s grip and found no evidence that Trayvon had handled it. Technicians testing other parts of the gun and holster were only able to definitively identify Zimmerman, the records show.

That’s important because Zimmerman told police he opened fire only after the teenager reached for the gun that Zimmerman wore in a holster on his waist. The DNA findings suggest there’s no evidence that Travyon touched the gun.

The new evidence also reveals that the local president of the NAACP sent Sanford Police Chief Bill Lee an email three days after the shooting, asking to meet and discuss it.

It’s unclear when or whether that meeting with Turner Clayton Jr. happened. The Sentinel is still reviewing hundreds of email received by Lee that are part of today’s document release.

Lee and his agency’s investigation into the shooting were harshly criticized by local and national civil rights leaders and Trayvon’s family. He was fired a few months later.

On March 8, the day Trayvon’s father held an Orlando press conference, calling for his son’s killer to be arrested, the case began drawing national media attention. Lee then began receiving a slew of angry emails from across the country.

“Is george Zimmerman a personal friend?” asked one non-grammatical emailer. “I cant imagine why he hasn’t been charged with 1st degree murder otherwise.”

Another emailer, who identified himself as a Chicago resident, called the lack of an arrest “sickening beyond words.” A man from Maryland asked Lee “what the hell kind of ‘Good old boys’ club are you running in your jurisdiction?”

Shellie Zimmerman may have concealed weapons license suspended by State

Shellie Zimmerman, wife of George Zimmerman, stands to lose her concealed weapons license according to a legal document filed by the State of Florida Division of Licensing.

According to the Division of Licensing the suspension stems from legal action, not a lack of renewal of the license. The notice of suspension was filed Sunday and gives Shellie 21 days to request a hearing to contest the action.

Shellie was thrust into the national spotlight earlier this year after her husband George, 28, shot and killed 17-year-old Trayvon Martin. George, who also had a concealed weapons license, claims he shot the teenager in self-defense.

George was charged with second-degree murder and during his initial bond hearing April 20, Shellie testified the couple had no access to funds despite having more than $100,000 in PayPal account created for George’s legal defense.

Subsequently the State Attorney’s Office charged Shellie with perjury in mid-June. She is currently out of jail on a $1,000 bond and has her next court appearance on Sept. 19 in front of Judge Debra Nelson – the same judge handling George’s case.

It was reported that George and Shellie Zimmerman obtained their concealed weapons licenses together in November 2009 while living in The Retreat at Twin Lakes – the same neighborhood where George would eventually have the altercation with Martin.

George Zimmerman defense wants Trayvon Martin school records

George Zimmerman‘s defense team wants educational and disciplinary records for Trayvon Martin, the Miami Gardens teen Zimmerman shot Feb. 26 in Sanford, according to a new post on the defense’s blog.

Zimmerman’s team posted this morning that it has begun its discovery process, issuing several subpoenas aimed at gathering records on Trayvon’s school history dating back to middle school.

The 17-year-old was staying with his father’s girlfriend at the time of the shooting. He had been suspended from school in Miami after being found with an empty marijuana baggie.

In its subpoenas, the neighborhood watch volunteer’s defense requests any “disciplinary notices and reports, suspension notices and reports, attendance records, tardiness records, awards given,” as well as extracurricular activities, class schedules and test scores.

The subpoenas are directed at Miami Carol City High School, Dr. Michael M. Krop Senior High, Norland Middle School and Miami-Dade County Public Schools. As the defense team’s blog post notes, such school records are not public.

Though he was never arrested, Trayvon had disciplinary issues before his suspension in February. The Miami Herald reported in March that he had been suspended twice before.

Appeals court grants George Zimmerman request for a new judge

The Fifth District Court of Appeal in Daytona Beach today ruled that second-degree murder suspect George Zimmerman should get a new judge.

A three-judge panel of that court concluded that Circuit Judge Kenneth Lester Jr. in Sanford went too far when he wrote that Zimmerman is a manipulator and made a veiled threat to hold him in contempt of court in the future.

“Although many of the allegations in Zimmerman’s motion [for a new judge], standing alone, do not meet the legal sufficiency test, and while this is admittedly a close call, upon careful review we find that the allegations, taken together, meet the threshold test of legal sufficiency,” the appeal court wrote in its opinion.

The appelate panel directed Lester to “enter an order of disqualification which requests the chief circuit judge to appoint a successor judge.”

Zimmerman is the 28-year-old Neighborhood Watch volunteer who shot and killed Trayvon Martin, an unarmed black 17-year-old in Sanford Feb. 26, setting off weeks of civil rights rallies by people demanding his arrest.

Six weeks after the shooting, Zimmerman was arrested and charged with second-degree murder by a special prosecutor.

Defense attorney Mark O’Mara had pressed for a new judge, arguing that Zimmerman does not believe he will be treated fairly by Lester because of a July 5 bond ruling.

In that nine-page order, the judge set Zimmerman’s bond at $1 million but also accused him of showing “blatant disregard for the judicial system” and “manipulating the system for his own benefit.”

The state argued that Lester should stay on the case, that he’s not biased, just someone who listened to evidence about Zimmerman and his wife hiding assets then not telling the truth about how much money they had during an April bond hearing.

Zimmerman’s wife, Shellie Zimmerman, has since been charged with perjury. She testified at that April 20 hearing that the couple was broke when they had $130,000 that they had been shifting from bank account to bank account, money donated at Zimmerman’s request by online supporters.

George Zimmerman testified at that same hearing but was not questioned about the couple’s finances. He made no attempt to correct his wife’s statements.

If today’s ruling stands, the case would likely pass to Circuit Judge Debra S. Nelson, another felony trial judge in Sanford.

Judge: Zimmerman Can Leave County to See Lawyers

The former neighborhood watch volunteer charged in the fatal shooting of Florida teenager Trayvon Martin can leave the county where he lives so he can meet with his attorneys, a judge said Friday.

Judge Kenneth Lester said he will adjust George Zimmerman’s bond terms so he can have easier access to his lawyers. The terms of Zimmerman’s $1 million bond that were set last month had required him to stay within Seminole County, where the unarmed 17-year-old was shot in February.

Zimmerman is charged with second-degree murder and has pleaded not guilty. He maintains he shot Martin in self-defense.

Zimmerman wasn’t charged with second-degree murder until 44 days after the shooting. During that time, protesters around the nation demanded Zimmerman’s arrest, and the Sanford Police Department was accused of racism and incompetence.

He’ll now be allowed to travel to nearby Orange County, where the offices of his attorneys are located. Any other movement will require he provide a detailed itinerary for continued GPS monitoring.

Mark O’Mara, Zimmerman’s lead attorney, said the allowance by the judge will make it a lot easier for his client to participate in the preparation of his defense.

Zimmerman, his wife and several family members have been in hiding since the shooting, fearing for their safety.

O’Mara said it is possible he will ask the judge to expand the order to allow Zimmerman to reside in Orange County as well.

“Or other places,” he said. “I don’t think he needs to be limited to central Florida. I don’t think he needs to be limited to Florida because of some of the threats and danger that’s still out there.”

George Zimmerman’s attorney will go back to court Friday to try and keep his medical records out of the prosecution’s hands.

SANFORD –

Attorneys in the George Zimmerman will go back to court Friday over a subpeona for records that the defense wants to keep out of the prosecution’s hands.

Prosecutors filed a subpeona for records from Altamonte Family Practice in Altamonte Springs. It’s not known why they want the documents.

But Zimmerman’s attorneys are objecting to the move. They say the documents are privileged records and totally irrelevant to the case. They also accused the state of releasing too much information to the public without regard for relevance or privacy.

George Zimmerman is charged with the second-degree murder in the death of Trayvon Martin back in February. Zimmerman says he shot Martin in self-defense.

Zimmerman is not expected to be present at the hearing, which will take place Friday at 8:30 a.m.
